Joseph has taken the lead roll acting for U-Drive Solutions (Gibraltar Ltd) (“U-Drive”) in an arbitration action against Enterprise Insurance Co Plc (“Enterprise”) in the sum of £65 million for breach of a strategic distributor agreement.
During the proceedings, Enterprise sought to make several applications, including an application in the High Court (Mercantile Court) 2015, whereby Enterprise sought to stay proceedings on the basis of “illegality and absence of valid arbitration clause”. On the day of the trial, Joseph was unexpectedly required to step-in, when UDrive’s Barrister, Mr Wayne Goldstein of 18 St John Street Chambers was unavoidably unable to attend the hearing.
Despite facing a most formidable opponent (Mr Ben Hubble QC, “Head of 4 New Square Chambers”), Joseph was successfully able to argue for an adjournment; UDrive ultimately went on to defeat Enterprise’s applications.
Joseph was again relied upon when Enterprise brought a further High Court application contending that the agreement did not exist and challenging the tribunal’s jurisdiction. That application too was dismissed, and the tribunal refused Enterprise’s subsequent application to deal with its jurisdiction objections in a preliminary hearing.
